Payment of unused RTT: how does it work?
The law on purchasing power adopted by Parliament in August 2022 has changed the rules for taking RTT. It is now possible for an employee to request the monetization of his or her untaken RTT. Under certain conditions, he can benefit from the payment of these RTT days, previously lost if not taken.
Is it possible to get paid for time off work?
The government allows the payment of untaken RTT. The employee has a choice: he or she can benefit from RTT days off or have these days monetized. This measure applies to RTTs between January 1, 2022 and December 31, 2025.
How can I get paid for my unused RTT?
To benefit from this payment, you must first be on a fixed day rate and meet certain conditions:
A written agreement between employee and employer is required, and must be renewed each year.
The employee must not exceed the maximum number of days worked in the year. It is determined by the Collective Bargaining Agreement or, failing that, by the Labor Code (235 days).
How do I calculate my RTT buyback?
The calculation for buying back RTT is quite simple:
Number of days in the year (365 days in 2022) – Saturdays and Sundays (105 in 2022) – 25 days paid vacation = 235 working days in 2022.
7 public holidays are to be counted this year. This means that 228 working days can be worked in 2022.
The annual fixed rate is still 218 days worked. It is therefore possible to buy back 10 days of RTT in 2022 (228 – 218 = 10).
